Associations, whether governed by Florida Statute Chapter 718 or 720 should have an election every year or as required by the Association’s governing documents. While many people dread election season, they really do not have to be so bad as long as the proper protocol is followed. It is important that prior to any election your association reviews its governing documents and ensures that its election and protocol complies with the Deceleration, By-laws, Rules and Regulations and Articles of Incorporation. Failure to do so may render the election of the newly elected Board of Directors invalid or worse can result in a recall of the election, forcing the association to spend unnecessary funds to either defend its election or hold new elections.
